Sigma Three Consulting, LCC
DBA Lowlander Tactical
Effective date: October 5, 2026
Last updated: October 5, 2026
These Terms of Service (“Terms”) govern your use of lowlandertactical.com (the “Site”) and your registration for and participation in training classes offered by Sigma Three Consulting, LLC DBA Lowlander Tactical (“we,” “us,” or “our”). Please read them carefully. By using the Site, creating an account, or registering for a class, you agree to these Terms. If you do not agree, do not use the Site or register for classes.
Our Privacy Policy explains how we handle your personal information and is part of these Terms.
- Who may use the Site and register for classes
- You must be at least 18 years old.
- Our classes are designed for law enforcement professionals. We may ask for verification of your eligibility and may decline or cancel a registration if we cannot verify it.
- If you register on behalf of your agency or another person, you confirm that you have authority to do so.
- Accounts and accurate information
If you create an account, you are responsible for keeping your login credentials confidential and for activity under your account. Notify us promptly at staff@performanceinpolicing.com if you suspect unauthorized use. You agree to provide accurate and current information, including your name, agency, and TCOLE Personal Identification Number (PID) where requested. Incorrect information can prevent your training from being reported.
- Our classes and our training provider partner
TCOLE credit. Classes that carry Texas Commission on Law Enforcement (TCOLE) credit are offered through a TCOLE contract training provider (“Provider Partner”). The Provider Partner is responsible for reporting eligible training hours to TCOLE. Classes will not be identified on the Site as carrying TCOLE credit, and may be offered for professional development only if not eligible for TCOLE credit.
Attendance requirements. TCOLE credit generally requires attendance for the entire class. You must arrive on time, remain for the full session, and complete any required assessments. If you miss any part of a class, we may be unable to report your hours, and refunds or make-up options are governed by Section 6.
Credit reporting. Reporting of hours is performed by the Provider Partner and is subject to TCOLE’s rules and processing. We do not guarantee that TCOLE will accept, post, or apply any hours to your license or training requirements, and you remain responsible for confirming that your training meets your own requirements and deadlines. If you believe your hours are missing, contact us at staff@performanceinpolicing.com, and we will work with the Provider Partner to correct records where appropriate.
Schedule and content changes. Dates, times, locations, instructors, and course content may change. We will notify you of material changes using the contact information you provide.
Not legal advice. Class content is provided for training purposes and is not legal advice. Laws, court decisions, and agency policies change and vary by jurisdiction. You are responsible for following the laws and the policies of your agency.
- Registration and payment
Prices and taxes. Prices are shown at registration and are in U.S. dollars. Prices may change, but changes will not affect completed registrations. Instruction is generally not subject to Texas sales tax, but we will add any tax that applies to materials, merchandise, food, or other items.
Card payments. If you pay by card, payment is processed by Stripe. We do not receive or store your full card number. By providing payment information, you authorize us and our processor to charge the amounts due.
Agency invoicing and purchase orders. If your agency will pay, you may request an invoice or submit a purchase order. Unless otherwise agreed in writing, invoices are due within [30] days of the invoice date, and your registration is secured only after we receive a valid purchase order, payment, or written commitment from the agency. The registrant and the agency are each responsible for ensuring the invoice is paid. We may release your seat if payment or a purchase order is not received by the date two weeks prior to class.
Payment problems. If a payment fails or is disputed, we may suspend your registration or account until the matter is resolved.
- Class conduct and safety
To keep our classes professional and safe, you agree to:
- Follow the instructor’s directions and all posted safety and facility rules.
- Treat instructors, staff, and other students with respect, and avoid harassment or disruptive behavior.
- Attend fit for participation and not under the influence of alcohol or any substance that could impair your safety or the safety of others.
- Follow the firearms, equipment, and range safety rules provided before any live-fire, force-on-force, or defensive tactics training, and bring only authorized equipment.
- Not bring unauthorized recording devices into class or record, photograph, or livestream the class without our written permission.
We may remove any person from a class for unsafe, disruptive, or unprofessional conduct, or for violating these Terms. Removal for cause does not entitle you to a refund or credit.
Waivers. Some classes, particularly those involving physical activity or specialized equipment, require you to sign a separate waiver and release before participating. If a waiver is required, you must complete it before attending. We may refuse participation to anyone who has not.
- Cancellations, transfers, and refunds
Your cancellations.
- More than [14] days before the class starts: full refund, less any non-refundable processing fee of 3%.
- [7 to 14] days before the class starts: [50%] refund or a credit toward a future class.
- Fewer than [7] days before the class starts, no-shows, and partial attendance: no refund. You may transfer your seat to another eligible person from your agency, at no charge, if you notify us at least [2] days before the class.
Transfers. You may request to move to another scheduled class subject to availability.
If we cancel or reschedule. If we cancel a class, we will notify you and offer a full refund or a credit toward another class. If we reschedule, you may accept the new date or request a full refund. We are not responsible for travel, lodging, time off, or other costs you incur in connection with a canceled or rescheduled class.
Minimum enrollment. We may cancel classes that do not meet minimum enrollment.
How refunds are issued. Approved refunds are returned to the original payment method within about [10] business days, or credited against the agency’s invoice. To request a refund or transfer, email staff@performanceinpolicing.com.
- Intellectual property and class materials
All class content, including curricula, slides, handouts, videos, exercises, and other materials, is owned by us, our instructors, or our licensors and is protected by copyright and other laws. We grant you a limited, personal, non-transferable license to use class materials for your own professional training and reference.
You may not copy, distribute, post online, sell, or create derivative works from class materials without our written permission. Some materials may contain sensitive tactical or procedural information intended only for authorized law enforcement personnel. You agree to keep such materials secure and not to share them with anyone who is not authorized to receive them.
The names, logos, and branding on the Site belong to us or our partners, and you may not use them without permission.
- Acceptable use of the Site
You agree not to:
- Use the Site for any unlawful purpose or in violation of these Terms.
- Submit false information or impersonate another person.
- Interfere with or disrupt the Site, its security, or its infrastructure.
- Attempt to gain unauthorized access to accounts, data, or systems, or use automated tools to scrape or overload the Site.
- Introduce viruses or other harmful code.
We may suspend or terminate access to the Site or your account if you violate these Terms or if we reasonably believe it is necessary to protect the Site, our students, or others.
- Third-party services and links
The Site may use or link to third-party services, including payment processors and our Provider Partner. We do not control those services and are not responsible for their content, availability, or practices. Your use of them is governed by their own terms and policies.
- Accessibility
We want our Site and classes to be accessible. If you need an accommodation to register for or attend a class, or have difficulty using any part of the Site, contact us at staff@performanceinpolicing.com and we will work with you in good faith to provide a reasonable accommodation.
- Disclaimers
THE SITE AND ALL CLASSES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT CLASSES WILL MEET YOUR SPECIFIC REQUIREMENTS, OR THAT ANY TRAINING HOURS WILL BE ACCEPTED BY ANY AGENCY OR REGULATOR.
- Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, WE AND OUR OWNERS, INSTRUCTORS, EMPLOYEES, AND PARTNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR OPPORTUNITY, ARISING FROM YOUR USE OF THE SITE OR PARTICIPATION IN CLASSES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SITE OR A CLASS WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE CLASS GIVING RISE TO THE CLAIM.
NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED BY LAW. ANY RELEASE OF LIABILITY FOR PHYSICAL PARTICIPATION IN A CLASS IS GOVERNED BY THE SEPARATE WAIVER YOU SIGN, NOT BY THIS SECTION.
- Indemnification
You agree to indemnify and hold us harmless from claims, losses, and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of class materials, or your violation of any law or third-party right. This section does not apply to the extent prohibited by law, including as to any governmental agency whose ability to indemnify is limited by law.
- Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. If a dispute arises, you agree to first contact us at staff@performanceinpolicing.com and try to resolve it informally for at least [30] days. If the dispute is not resolved, it must be brought in the state or federal courts located in Denton County, Texas, and you consent to the jurisdiction and venue of those courts.
- Changes to the Site and these Terms
We may modify the Site or discontinue features at any time. We may update these Terms from time to time by posting the updated version with a new “Last updated” date. Changes apply going forward, and your continued use of the Site or registration for classes after the update means you accept the revised Terms. If you registered for a class before a material change, the Terms in effect when you registered will apply to that class unless you agree otherwise.
- General
These Terms, together with our Privacy Policy and any waiver or written agreement with you, are the entire agreement between you and us on their subject. If any part is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent, but we may assign them in connection with a merger, sale, or transfer of our business. Nothing in these Terms creates a partnership, joint venture, or employment relationship between you and us.
